Terms and conditions.

The rules that govern use of the TrustDots website, mobile apps, browser extension, and related services.

These Terms and Conditions (“Terms”) are a legally binding agreement between you and TrustDots LLC (“TrustDots,” “we,” “us,” or “our”) concerning your access to and use of trustdots.com, TrustDots mobile apps, the TrustDots browser extension, and related services (collectively, the “Services”). By accessing the Services, you agree to these Terms. If you do not agree, do not use the Services.

TrustDots is a consumer-information platform that provides evidence-based information and trust assessments about products, brands, and sellers, including information about safety, recalls, ownership, certifications, environmental and labor practices, and shopper feedback.

1. Our services

You may use the Services if you are at least 18 years old. A minor dependent may use the Services only when their adult parent or legal guardian consents to their use and accepts these Terms on the minor’s behalf.

People who access the Services from a location where their use would be unlawful do so on their own initiative and are responsible for following applicable local law. The Services are not designed for compliance with industry-specific regimes such as HIPAA, FISMA, or GLBA.

2. Intellectual property rights

We own or license the source code, databases, functionality, software, designs, text, images, graphics, trademarks, service marks, and logos in the Services (collectively, the “Content” and “Marks”). They are protected by intellectual-property and unfair-competition laws.

Subject to these Terms, we grant you a revocable, non-exclusive, non-transferable license to access the Services and download or print Content you properly access solely for personal, non-commercial use or an internal business purpose. No other copying, republication, distribution, sale, licensing, or commercial exploitation is permitted without our prior written permission.

Questions, comments, suggestions, corrections, dispute evidence, and other materials you send us about the Services (“Submissions”) must be lawful, accurate to the best of your knowledge, non-confidential except for personal information handled as described below, and yours to submit. You grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish, and share only the portions of Submissions that do not contain personal information or sensitive personal information, for operating, evaluating, correcting, and improving the Services. This broad license does not apply to personal information or sensitive personal information. You retain ownership of any underlying rights you hold.

Minimize personal information in Submissions and redact personal or sensitive details that are not necessary for us to evaluate a correction or dispute. We may process personal information included in a Submission only as reasonably necessary to evaluate the correction or dispute and to operate, secure, or improve the Services. Its use, retention, disclosure, and deletion are governed by our Privacy Policy.

3. User representations

If you are an adult using the Services, you represent that you have legal capacity, will comply with these Terms, will not access the Services through unauthorized automated means, and will not use the Services for an unlawful or unauthorized purpose. If you are an adult parent or legal guardian permitting a minor dependent to use the Services, you accept these Terms and make those representations on the minor’s behalf, and you consent to the minor’s use.

If information you provide is materially untrue, inaccurate, outdated, or incomplete, we may suspend or terminate your account or access.

4. Prohibited activities

You may use the Services only for their intended purposes. You may not systematically extract or compile our data without permission; circumvent security or access controls; mislead, impersonate, harass, or harm others; submit false reports; introduce malware or disruptive material; overload or interfere with the Services; remove proprietary notices; frame the Services without authorization; reverse engineer software except where law expressly permits it; collect user information for unsolicited communications; create accounts through false pretenses; or use the Services or Content to build a competing commercial product without our written approval.

5. Feedback and other submissions

The Services may allow you to send feedback, corrections, evidence supporting a dispute, or similar submissions. You are responsible for what you submit and represent that it does not violate law, these Terms, privacy or publicity rights, or third-party intellectual-property rights. Do not submit confidential information or personal information you lack authority to provide.

We may review, retain, use, and share submissions as reasonably needed to investigate claims, improve our information and assessments, enforce these Terms, or comply with law. Our Privacy Policy explains how we process personal information.

6. Mobile application license

If you use a TrustDots mobile app, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use it on devices you own or control. You may not modify, decrypt, decompile, disassemble, derive source code from, commercially exploit, or make the app available for simultaneous use across a network except where applicable law does not allow those restrictions.

Apple App Store and Google Play terms also apply. The applicable store is a third-party beneficiary of this mobile-app license and may enforce it. TrustDots, not the store, is responsible for the app and for any support or claims to the extent required by law.

7. Services management

We may monitor the Services for violations, restrict or disable access or submissions, remove burdensome or unlawful material, report suspected unlawful conduct, and otherwise manage the Services to protect our rights, users, and systems.

8. Privacy policy

Please review our Privacy Policy, which is incorporated into these Terms. The Services are hosted in the United States; use from elsewhere may involve transferring information to the United States as described in that policy.

9. Term and termination

These Terms remain effective while you use the Services. To the fullest extent permitted by law, we may deny, suspend, or terminate access for a violation of these Terms or applicable law and may take appropriate civil, criminal, or injunctive action.

10. Modifications and interruptions

We may modify, suspend, or discontinue all or part of the Services. We do not guarantee that the Services will always be available, error-free, or maintained, and we are not responsible for loss or inconvenience caused by downtime to the fullest extent permitted by law.

We may update these Terms from time to time. An updated “Last updated” date at the top indicates the current version. Continuing to use the Services after revised Terms take effect means you accept them.

11. Governing law

Florida law governs these Terms and your use of the Services, without regard to conflict-of-law principles.

12. Dispute resolution

Informal negotiations

Before starting arbitration, each party agrees to try in good faith to resolve a dispute informally for at least 30 days after one party gives the other written notice.

Binding arbitration

If informal negotiation does not resolve a dispute, it will be finally and exclusively resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the applicable Commercial Arbitration Rules and, when applicable, Consumer Arbitration Rules. YOU UNDERSTAND THAT ARBITRATION REPLACES THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL. Fees will be governed by applicable AAA rules. Arbitration may proceed in person, by documents, by phone, or online, and the arbitrator will issue a written decision.

Unless applicable AAA rules or law require otherwise, arbitration will take place in Miami-Dade County, Florida. Any court proceeding permitted under these Terms, including proceedings to compel arbitration or enforce an award, must be brought in the state or federal courts located in Miami-Dade County, Florida.

Restrictions and exceptions

To the fullest extent permitted by law, arbitration is individual only and may not be joined with another proceeding or brought as a class or representative action. Disputes concerning intellectual-property rights, theft, piracy, invasion of privacy, unauthorized use, or requests for injunctive relief are excluded from informal negotiation and arbitration. Any unenforceable portion will be severed, and the affected dispute will be heard by a court with jurisdiction in Miami-Dade County.

13. Corrections

The Services may contain typographical errors, inaccuracies, or omissions. We may correct or update information at any time without prior notice. Trust assessments and underlying information may change as new or better evidence becomes available.

14. Disclaimer

TrustDots provides evidence-based consumer information and trust assessments. TrustDots does not sell, guarantee, endorse, or warrant any third-party product, brand, seller, claim, or transaction. Assessments reflect available evidence and may change when the evidence changes. Use your own judgment and appropriate caution.

15. Limitations of liability

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. If those laws apply, some limitations above may not apply and you may have additional rights.

16. Indemnification

You agree to defend, indemnify, and hold harmless TrustDots LLC, its affiliates, and their officers, agents, partners, and employees from third-party claims, losses, liabilities, and reasonable legal expenses arising from your use of the Services, breach of these Terms, breach of your representations, violation of third-party rights, or harmful acts toward another user. We may assume control of the defense at your expense, and you agree to cooperate.

17. User data

We may maintain data you transmit to operate the Services and data relating to your use. Although we may perform routine backups, you are responsible for data you transmit and for keeping your own copies where appropriate. Our handling of personal information is governed by the Privacy Policy.

18. Electronic communications and signatures

Using the Services, emailing us, and submitting online forms are electronic communications. You consent to receive communications electronically and agree that electronic agreements, notices, disclosures, signatures, and records satisfy legal writing requirements to the extent permitted by law.

19. California users and residents

20. Miscellaneous

These Terms and policies posted for the Services are the entire agreement between you and us concerning the Services. A failure to enforce a provision is not a waiver. We may assign our rights and obligations. We are not responsible for delay or failure caused by events beyond our reasonable control. If a provision is unlawful or unenforceable, it is severed without affecting the rest. These Terms create no joint venture, partnership, employment, or agency relationship.
